Estate Planning

What is estate planning? Why do I need an estate plan?

Estate planning involves planning to make sure that your wishes and goals are met in the event of your death, serious illness, or other major accident. This planning usually involves decision-making regarding the distribution of your assets and belongings as well as appointing people to make other decisions for you. Also, if you have children, estate planning helps plan for their care in the event of tragedy.Too often, individuals and families put off estate planning because it can be uncomfortable and difficult to think about. While nobody likes to think about their own death or the possibility of a terrible accident or illness that prevents them from making their own decisions, it is absolutely necessary in order to protect loved ones.

Avoiding important estate planning decisions now usually means that someone else has to make them for you later. The result may not reflect what you would have wanted and may not be in the best interests of your family; it could even fail to meet their future needs. Without an estate plan, your family (and the state of California) will not have any clear direction as to your wishes. How your assets are divided, who makes financial and health care decisions for you in the event that you can’t do so yourself, and who will be the guardian of minor children will be left up to state law and a judge–someone who does not know your family and may not be able to make the best decisions. Your desires and goals could be completely disregarded.

Even worse, there could be a long, drawn-out court battle to determine child custody/guardianship, financial management decisions, medical care decisions, and end-of-life decisions if you don’t have an estate plan. (Remember the famous case involving Terri Schiavo?). This is not something you would want your family to fight over while in mourning.
